General conditions

Article 1

Introduction and effectiveness of the General Conditions

These general conditions of sale (hereinafter, ” General Conditions “) have as their object the regulation of the purchase of products, carried out remotely and made available, via the Internet, from the website www.passoladro.local (hereinafter, the ” Site “) in compliance with the Italian legislation referred to in d. lgs. n. 206/2005 and subsequent amendments and additions (hereinafter, the “Consumer Code “).

In the event that the person making purchases on the Site requests an invoice and / or in any case is not a “consumer or user” as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the provisions that pursuant to the same Consumer Code apply only to “consumers” will not apply.

Contracts concluded with Passo Ladro through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

Article 2

Choose and order the Products

The characteristics and the price of the various products for sale on the Site (hereinafter “ Product ” or “ Products “) Are shown on the page relating to each Product.

To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained on the Site. The Customer must add the Product to the “Cart” and, after having read the General Conditions and the Privacy Policy and confirmed their acceptance, must enter the shipping and billing information, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions.

The contract stipulated between Passo Ladro and the Customer must be considered concluded with the acceptance of the order by Passo Ladro. This acceptance is communicated to the Customer through an e-mail confirming the order itself containing a reference to these General Conditions, the order number, the shipping and billing data, the list of Products ordered with their essential characteristics. and the total price, including delivery costs.

Upon receipt of the order, Passo Ladro reserves the right to verify the actual availability of the products ordered; if some Products are not in stock, Passo Ladro reserves the right to process the order for the part of the Products available.

In the event of one or more products missing, the information relating to the final charge or refund will be contained in the shipping confirmation e-mail and will vary depending on the payment method used.


During shipment, only the cost of the products actually sent will be charged and any pre-authorized and unused amounts will be released on the payment method chosen by the Customer in a short time, according to the timing provided by the payment method itself.

Article 3

Product Information

The information and characteristics relating to the Products are available, with the relative Product codes, on the Site.

The photographic image of the Products on the Site, where available, has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.

Prices and shipping

Product prices are inclusive of all taxes and duties .

Article 5

Methods of payment and billing

5.1 Payment methods

The Customer may pay the price of the Products and the related delivery costs by credit card, PayPal, bank transfer, prepaid cards.

To ensure maximum security, the Customer will carry out the payment transaction directly on the bank’s secure server.

Once the order is confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his account or using a card, even prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relative conditions.

  • Wire transfer

The customer must make the transfer within 2 days from the date of the order. If the payment does not occur within 2 days, the order will be canceled and the goods made available again for purchase by other customers. The Customer who has not made the transfer may be contacted by the Customer Service in order to clarify whether the cause of the non-credit is due to the Customer’s will not to confirm the purchase or to other causes.

Reason: the Customer must indicate in the reason for the transfer the date and the order number, which can be found in the confirmation e-mail (eg “Order dated 01/01/21 n. 100012345”).

5.2 Invoicing of orders

If the purchase is made by a natural or legal person acting in the exercise of his business, commercial, craft or professional activity, or one of his professional intermediaries (hereinafter “Professional”), it will be possible to request an invoice by selecting the appropriate box during the order procedure and entering the billing data including tax code, VAT number and Unique Code or PEC address when ordering, it will not be possible to request it later.

Article 6

Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure.

All purchases will be delivered by express courier (hereinafter, “ Courier service “) From Monday to Friday, excluding holidays and national holidays. Passo Ladro is not responsible for unforeseeable delays or those not attributable to it.

Once the Products have been shipped, the Customer will receive a confirmation email which will include a link to refer to for tracking the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within a period of 15 (fifteen) working days (term valid for Italy) starting from the day following that in which Passo Ladro confirmed the order to the Customer by means of a specific order confirmation e-mail.

Passo Ladro cannot be held responsible for any damage or deterioration of the products or for tampering with the packaging that occurred during the delivery operations. Therefore, at the time of delivery of the purchased Products and in any case before signing the relative receipt submitted by the Courier, the Customer is required to check that the packaging is intact and intact, not damaged, not tampered with, not wet or in any case not altered, even in closing materials (adhesive tape or plastic straps).

The Customer is also required to verify that the number of packages delivered corresponds to that indicated in the transport document, that the products delivered correspond to those ordered with specific reference to the order confirmation e-mail.

If the packaging does not comply with the provisions of the previous point, the Customer may refuse the delivery or sign the delivery receipt “WITH RESERVE OF CONTROL” specifying clearly and in detail the reasons, otherwise the delivery is considered accepted.

When verifying the existence of any damage to the Products or packaging, or any discrepancy between the Products and the order sent, the Customer must lodge a complaint (pursuant to art.10 of these General Conditions) to Passo Ladro within the deadline of eight days from receipt by sending written notice by registered letter with return receipt or by certified e-mail to Passo Ladro. The complaint must be accompanied by photographic material certifying the problem reported and, where configurable, by a copy of the coupon containing the words “WITH RESERVE OF CONTROL”.

Article 7

Right of withdrawal

In addition to the cases indicated in the Introduction (non-consumer customer and / or requesting an invoice and / or Professional), pursuant to and for the purposes of art. 59 d. lgs. 21 February 2014, n. 21 “ Implementation of directive 2011/83 / EU on consumer rights, amending directives 93/13 / EEC and 1999/44 / EC and repealing directives 85/577 / EEC and 97/7 / EC “The right of withdrawal is excluded in some cases including the following:

    • order of Products that are likely to deteriorate or expire rapidly;
    • order of products made to measure or clearly personalized;
    • order of sealed Products that cannot be returned for hygienic reasons or related to health protection or that have been opened after delivery.

With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that “risk deteriorating or expire rapidly” include all food products (including wines, spirits, oils and beverages).

To protect our customers and for hygienic reasons, the right of withdrawal is attributed only to products that can be put back on the market without endangering the health of consumers; for this reason it is not possible to return food products whose adequate conservation cannot be guaranteed.

Article 8

Change order shipping address

The Customer may request the change of the shipping address of the order within 6 hours of receiving the order confirmation e-mail; after this deadline the order will be processed and it will no longer be possible to request a change of shipping address.

Passo Ladro reserves the right to cancel the order in the event of unforeseeable situations of difficulty, by informing the Customer by e-mail, or, upon agreement with the same, to change the day and / or time of delivery.

Article 9

Errors and limitations of liability

The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which therefore Passo Ladro cannot be held responsible, except in the case of willful misconduct or gross negligence.

Passo Ladro reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to change or update information at any time without prior notice, without prejudice to the Customer’s rights under these Conditions Generali and the Consumer Code.

Applicable law and competent court

The sales contract between the customer and Passo Ladro is concluded in Italy and governed by Italian law. For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, the court of his / her town of residence or of domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Brescia, any other competent court excluded.
